Mr. Infelise is a senior trial attorney specializing in high stakes disputes. In an era in which few matters actually go to trial, he has tried thirty-six matters to judgment. Mr. Infelise handles matters in a broad range of substantive areas.

He has litigated (i) complex tax deferral and minimization strategies for high net-worth taxpayers against authorities and major accounting firms; (ii) complex real estate and commercial disputes; and (iii) environmental matters involving the federal Comprehensive Environmental Response, Compensation and Liability Act, the federal Resource Conservation and Recovery Act, state law analogues, California’s Proposition 65, and common law claims.

Mr. Infelise’s clients are institutions and entrepreneurs in the real estate industry, public utilities, financial institutions, investment banks and high net-worth individuals.

Mr. Infelise represents taxpayers in matters before the Internal Revenue Service, the U.S. Department of Justice, and the California Franchise Tax Board.

On the environmental side, he was lead counsel for the lender and developer plaintiffs in RTC v. Rossmoor, 34 Cal.App.4th 771 (1995), one of the few environmental cost recovery actions tried to a jury. He was actively involved on behalf of the developer plaintiff in Bixby Ranch Co. v. Spectrol Electronics, the seminal California case involving stigma damages. Mr. Infelise has represented clients in environmental matters before the U.S. Environmental Protection Agency, Cal/EPA, the State Water Resources Control Board and its Regional Boards, the Department of Toxic Substances Control, and county and municipal agencies. Mr. Infelise also counsels real estate developers with the development of brownfield sites.

Mr. Infelise is one of the leading experts in the use of judicial reference as a mechanism for potential defendants to avoid jury trials. He represented the prevailing parties in Greenbriar Homes Communities, Inc. v. Superior Court (2004) 117 Cal.App.4th 337, and Trend Homes Communities, Inc. v. Superior Court (2004) 131 Cal.App.4th 950, the seminal decisions upholding contracting parties’ choice of dispute resolution mechanisms.

Finally, Mr. Infelise focuses on issues involving electrical generation and supply. He represented the commercial building industry in proceedings before the California Public Utilities Commission relating to creating a competitive platform to provide power to office buildings. He negotiates electrical supply contracts for end users.

In addition to his trial practice, since 1994 he has served on the faculty at the U.C. Berkeley School of Law (formerly Boalt Hall). He teaches Environmental Law and Policy; The Law of Hazardous Waste: CERCLA, RCRA and Common Law Claims; the Environmental Law Writing Seminar; the Workshop on Development and the Environment; and Remedies. In 2003, he was named the interim director of Berkeley Law’s highly-ranked environmental law program. From 2009 to 2010, Mr. Infelise served as the acting executive director of Berkeley Law’s Center for Law, Energy and the Environment, and currently serves as the chairperson of its Advisory Committee. In 2013, he was named a John and Elizabeth Boalt Lecturer.

Mr. Infelise graduated phi beta kappa from the University of California at Berkeley in 1977, and from Boalt Hall in 1980. Thereafter, Mr. Infelise joined the Los Angeles office of Cox, Castle & Nicholson LLP. In 1998, Mr. Infelise opened the firm's San Francisco office, and later served as its managing partner.
