Ali P. Hamidi is a partner in the San Francisco office of Cox, Castle & Nicholson LLP. Mr. Hamidi’s practice is concentrated in commercial business and real estate litigation, and employment litigation and counseling.
Mr. Hamidi’s commercial and real estate experience includes the representation of public and private companies in securities cases, contract actions, shareholder disputes, trade secret violation and unfair competition cases, and real estate disputes involving guaranty and lender liability, landlord- tenant, environmental claims, disability-access claims, and construction defect and delay claims.
Mr. Hamidi’s employment practice includes the representation of companies against claims of discrimination, sexual harassment, wrongful discharge, wage and hour claims, and other employee grievances. He has represented employers before the EEOC, DFEH, U.S. Department of Labor, and the California Labor Commissioner. He has counseled clients on the creation and implementation of human resource policies and procedures in protecting intellectual property, non-compete enforcement and avoidance, employee terminations and reductions in force. He has also negotiated employment agreements, and compensation and severance packages for directors and senior executives.
Mr. Hamidi has co-chaired jury and bench trials in California, Colorado, and Virginia. He has also successfully arbitrated and mediated numerous cases before JAMS, ADR Services, and the American Arbitration Association.
Representative Litigation Matters
- Co-chaired 8 week jury trial in California state court defending national homebuilder in a class action involving claims of fraud, negligence and breach of warranty. Obtained favorable settlement for client prior to jury deliberation.
- Co-chaired 12 week bench trial in California state court prosecuting environmental claims on behalf of a redevelopment agency against paint manufacturing company. Obtained favorable ruling finding defendant liable for contamination.
- Defended national hotel developer in a class action securities case in federal court in California. Caused dismissal of all claims at pleading stage. Currently handling appeal before the Ninth Circuit.
- Co-chaired jury trial in federal court in Colorado defending national defense contractor against wrongful termination claims. Obtained favorable settlement for client in initial stages of trial.
- Co-chaired bench trial in federal court in Virginia defending national defense contractor against national brokerage houses claiming fees related to a company acquisition.
- Prosecuted trade secret misappropriation and copyright infringement suit on behalf of Fortune 500 company which resulted in the return of the technology and monetary concessions by defendants.
- Defended Fortune 500 company and its various subsidiaries in a dispute involving installation of a wireless network in Africa. Defeated plaintiff’s claim at summary judgment stage. Succeeded on unjust enrichment counter-claim against plaintiff.
- Prosecuted antitrust claims on behalf of vehicle dealers nationwide against national car manufacturer.
Mr. Hamidi received his J.D. in 1996 and his M.A. in International Affairs in 1997 from Golden Gate University. He earned his B.A. from the University of California at Davis in 1991.
Mr. Hamidi is admitted to the California State courts as well as the Northern, Southern, Eastern and Central District Courts of California and the District Court of Colorado. He is a member of the California Star Bar Association and the San Francisco Bar Association, Employment Section.
