Accusations of wind theft among neighboring wind farms are on the rise, according to land use and environmental attorneys, the Daily Journal reported on June 9, 2011. Whether such disputes qualify as environmental or economic impacts is the sourcing of ongoing debate, noted Anne Mudge, the co-chair of Cox Castle & Nicholson’s Renewable Energy & Climate Change practice. “It’s pretty clear it’s an economic debate,” Mudge added. “Wake effects don’t have independent impacts on flora and fauna. But people will use CEQA to get at neighboring projects.”
