Why CEQA May Finally Get Its Rewrite

Cox, Castle & Nicholson partner Michael Zischke was mentioned in a Nov. 2, 2012 article in The Recorder about how, after years of attempts, opponents could soon be successful in their efforts to change the California Environmental Quality Act (CEQA). The article discusses how key politicians who were previously big supporters of the law are now open to changing it, in part due to the state's high unemployment rate.
 
Among the proposals being discussed are limiting the circumstances under which CEQA challenges can be filed, and making CEQA litigants incur a greater share of the costs of litigation as well as name their financial backers. Zischke was mentioned in the article as part of a list of so-called “CEQA nerds,” a group of veteran, developer-side land-use attorneys who have been pushing for an overhaul of the law.
