Overview

Kevin is a litigation associate focused on fiduciary, employee benefit, ERISA, and employment law matters. A primary focus of Kevin’s practice is the counseling and representation of pension, health and welfare, and training benefit plans, trustees, and plan service-providers. He has experience counseling trustees of multiemployer employment-benefit-related trusts with respect to the fulfillment of their fiduciary and statutory duties and representing such trustees in their dealings with third parties. 

Kevin has successfully represented employee benefit plan trustees against claims of breach of fiduciary duties and has prosecuted actions on behalf of plan trustees in withdrawal liability matters, and against service providers, insurance carriers, and other third parties. He has also litigated ERISA participant claims in a variety of areas, including defense of direct challenges that the plan in question is unlawful or improperly administered. Kevin has authored “friend of the Court” briefs, including those addressing issues of importance to trust funds in cases before the Federal appellate courts.

Kevin is experienced in prevailing wage law interpretation and litigation and is active in public works, prevailing wage, and other labor- and construction-related issues. He regularly represents trade associations and individual developers and contractors before the Department of Industrial Relations and in the courts. Additionally, Kevin has experience in employment litigation and advice and counseling, and has defended employers in discrimination, sexual harassment, wrongful termination, and wage and hour cases.

He received his J.D. at the University of Southern California, Gould School of Law, where he served as an Executive Editor for an honors law journal, and also served as a Judicial Extern for the Honorable Gregory Alcaron at the Los Angeles Superior Court.

Prior to attending law school, Kevin received his B.A., magna cum laude, in Philosophy and English Literature from Seattle University.
