Overview

Real Estate Development

Veena is a real estate attorney representing clients in all aspects of land development and real estate transactions including negotiating and preparing purchase and sale agreements, leases, easement agreements, development agreements/disposition and development agreements with both private and public entities, site development and construction agreements, cost sharing agreements, shopping center governance documents, entitlements, and construction agreements for a wide range of industries including big box, mixed use, commercial, medical and renewable energy.  Veena also advises clients on construction, operational and property management related issues.  One focus of her practice is site assembly, title and survey review, infrastructure development (sewer, water, etc.) and subdivision map act issues. Veena also represent landlords, property management companies and homeowner associations, tenants in office, medical office, and retail leasing, lease-related disputes, CC&R related issues, and property management concerns. 

Renewable Energy

Veena also has extensive experience in renewable energy and advises both developers and lenders on a broad range of renewable energy projects, from rooftop solar to utility scale solar, utility scale wind projects, geothermal power plants and biofuels plants, both in California and other states across the nation, with respect to site assembly (lease, easements or site acquisition), water issues, access easements, financing, reassessment tax issues, mineral issues, title and survey and negotiating with local agencies.  She has a particular experience with implementing the California Rooftop Solar Mandate and with assisting existing developments in adding microgrids and related renewable energy to their projects.

Groundwater

Veena regularly assist clients in water rights permitting, obtaining and disposing of water rights (permanent and temporary) in adjudicated and SGMA managed groundwater basins, the administrative reporting for water rights, well drilling permits and intervening in the Judgments for adjudicated water basins.  Veena also negotiates private water supply agreements and well use easements for groundwater basins.

Experience

Represented a client in the purchase of a biofuels facility.

Represented an irrigation district in structuring of a geothermal resources lease.

Represented various solar developers in the land assembly of 50 MW to 200 MW solar farms.

Represented a hospital campus in the installation of a solar and battery storage system.

Located Antelope Valley Water Basin water rights for sale for landowner, negotiated sale of permanent Production Rights and temporary Carry Over Rights, structured a water holding entity for the purchase and holding of water for all client’s projects in the Basin, assisted client in navigating the Watermaster water rights transfer process, “harm to the basin” analysis, and well drilling requirements, intervened client into the Judgment, and assisted client in the annual reporting for such water rights.  

Negotiated Water Supply Agreement for client in the Mojave Water Basin for construction water and operation and maintenance water, a well easement for pumping such water, and a settlement agreement with the Mojave Watermaster the pumping of such water rights. 

Negotiated the County acquisition of a client’s water wells and water system.

Represented a client in the structuring of a temporary wastewater treatment plant agreement with a private operator, negotiated the purchase of a wastewater treatment plant with Cal Water, assisted client with a dedication of wastewater treatment plant and infrastructure system to a County.
